Terms and Conditions 2024
These Terms and Conditions ("Terms") govern your purchase of memberships or classes from Sunny Space Studio Ltd. through our website and the MindBody app. By purchasing a membership or class, you agree to these Terms.
1. Membership and Class Purchases
1.1 Eligibility
To purchase a membership or class, you must be at least 18 years old or, if under 18, have the consent of a parent or guardian. Additionally, anyone under 16 years old is required to have parent/guardian supervision. By purchasing, you confirm that you meet this requirement.
1.2 Membership Types
We offer various types of memberships, including but not limited to:
Monthly Memberships
Class Packages
Details of each membership type, including pricing and benefits, are available on our website and the MindBody app.
1.3 Class Bookings
Classes can be booked individually or as part of a membership. Bookings are subject to availability and can be made through our website or the MindBody app.
2. Payments
2.1 Payment Methods
We accept various payment methods, including credit/debit cards and other online payment systems.
2.2 Payment Terms
Payments for memberships and classes must be made in full at the time of purchase. Recurring payments for memberships will be charged automatically according to the billing cycle selected. Any late payments may result in the suspension or termination of membership privileges.
3. Cancellations and Refunds
3.1 Membership Cancellations
Memberships may be canceled according to the terms specific to each membership type. Monthly memberships should be canceled with 14 days' notice before the next billing cycle to avoid a charge. Prepaid memberships are non-refundable and non-transferable.
3.2 Class Cancellations
Individual classes can be canceled or rescheduled up to 8 hours before the class start time. Late cancellations or no-shows may be subject to a $15 fee and/or loss of class credit.
3.3 Refund Policy
Refunds are issued at the discretion of Sunny Space Studio Ltd. and are typically processed within 30 days of the request. Requests for refunds can be made by contacting us directly at info@sunnyspacestudio.ca
4. Use of Services
4.1 Conduct
You agree to conduct yourself respectfully and appropriately while participating in our classes and using our facilities. Disruptive behavior may result in the suspension or termination of your membership or access to classes.
4.2 Health and Safety
By purchasing a membership or class, you confirm that you are in good health and physically able to participate in Pilates exercises. You agree to inform us of any medical conditions, injuries, or pregnancy that may affect your ability to participate.
5. Privacy
Your personal information is handled in accordance with our Privacy Policy. By purchasing a membership or class, you consent to the collection and use of your information as described in the Privacy Policy.
6. Modifications
6.1 Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website and the MindBody app. Your continued use of our services after changes are posted constitutes your acceptance of the new Terms.
6.2 Price Changes
All memberships are subject to an annual price change. Prices for memberships and classes are not locked-in and may be adjusted by Sunny Space Studio Ltd. at any time. We will provide a minimum of 60 days' notice via email to inform clients of any price changes.
6.3 Changes to Services
We may modify or discontinue any aspect of our services, including classes and memberships, at any time without notice. We will make reasonable efforts to notify you of significant changes.
7. Additional Provisions
7.1 Intellectual Property
All intellectual property rights associated with Sunny Space Studio Ltd., including but not limited to logos, branding, and proprietary workout routines, are the property of Sunny Space Studio Ltd. Members are granted a limited, non-exclusive, non-transferable right to use such intellectual property solely for the purpose of participating in classes and using studio facilities.
7.2 Disclaimer of Liability
Participation in fitness classes and use of studio facilities carry inherent risks, including but not limited to the risk of personal injury or property damage. By purchasing a membership or class, members acknowledge and accept these risks. Sunny Space Studio Ltd. shall not be liable for any injuries, damages, or losses sustained by members while participating in classes or using studio facilities.
7.3 Code of Conduct
Members are expected to conduct themselves respectfully and responsibly while participating in classes and using studio facilities. Disruptive behavior, harassment, or violation of studio policies may result in the suspension or termination of membership.
7.4 Termination Policy
Sunny Space Studio Ltd. reserves the right to terminate a membership at its discretion, including but not limited to cases of repeated violation of studio policies, disruptive behavior, or non-payment of fees.
7.5 Force Majeure
In the event of unforeseen circumstances beyond its control, including but not limited to natural disasters, pandemics, or government mandates, Sunny Space Studio Ltd. may be unable to provide services as scheduled. In such cases, Sunny Space Studio Ltd. shall not be liable for any damages or losses incurred by members, and membership fees will not be refunded.
7.6 Dispute Resolution
Any disputes arising out of or relating to these Terms shall be resolved through mediation or arbitration in accordance with the laws of the Province of British Columbia, Canada. Both parties agree to submit to the exclusive jurisdiction of the courts of the Province of British Columbia.
7.7 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7.8 Waiver
The failure of Sunny Space Studio Ltd. to enforce any provision of these Terms shall not constitute a waiver of its right to enforce such provision in the future.
8. Limitation of Liability
To the maximum extent permitted by law, Sunny Space Studio Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, including but not limited to personal injury or property damage.
9. Liability for Lost or Damaged Items
Sunny Space Studio Ltd. shall not be liable for any lost or damaged items left in the studio premises. Members are responsible for the safekeeping of their personal belongings and are encouraged not to leave valuables unattended. Any items found on the premises will be held for a limited time before being disposed of or donated.
10. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada. Any disputes arising out of or relating to these Terms shall be resolved in the courts of the Province of British Columbia.
